By accessing or using Diversifly Travel’s website and services (collectively, the “Platform”), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform.

Diversifly Travel reserves the right to modify these Terms of Use at any time. Any changes will be posted on the Platform, and the “Last Updated” date will be revised accordingly. Your continued use of the Platform following any such changes constitutes your acceptance of the new terms.

3. Purpose and Eligibility

Diversifly Travel is a platform created to foster safe and supportive travel connections among women who may face gender-specific safety concerns when travelling alone. The Platform is designed to prioritise the safety, comfort, and empowerment of women in solo travel contexts.

Access to the Platform is therefore intended for individuals who:

Identify as women; and
Are at least 18 years of age.

By using this Platform, you represent and warrant that you meet the above eligibility criteria. Diversifly Travel reserves the right to remove or restrict accounts that do not align with the intended use of the Platform or that compromise the safety of the community.

4. Account Registration

To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You agree not to engage in any of the following prohibited activities:

Using the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
Interfering with or disrupting the Platform or servers or networks connected to the Platform.
Misrepresenting your identity or intent on the Platform.
Attempting to gain unauthorised access to the Platform or other users' accounts.
Posting or transmitting any content that is illegal, harmful, defamatory, obscene, or otherwise objectionable.
Using the Platform to harass, abuse, or harm another person.

7. Content Ownership

All content on the Platform, including text, graphics, logos, and images, is the property of Diversifly Travel or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any content from the Platform without prior written permission from Diversifly Travel.

8. User Content

By submitting content to the Platform, you grant Diversifly Travel a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute such content. You are solely responsible for the content you submit and must ensure that it does not infringe on any third-party rights.

9. Disclaimers

9.1 No Background or Identity Verification
Diversifly Travel does not conduct criminal background checks, identity verification, or screening of its users. While we are committed to fostering a safe and supportive environment, we make no representations or warranties as to the conduct, identity, intentions, legitimacy, or accuracy of any user on or off the Platform.

You acknowledge and accept that interactions on the Platform are at your own discretion and risk.

9.2 No Guarantees of Conduct
Diversifly Travel does not and cannot control the behaviour of users and disclaims all liability arising from user misconduct, whether online or in person. This includes (but is not limited to) fraud, harassment, abuse, impersonation, coercion, or illegal activity.

We reserve the right, but have no obligation, to investigate, screen, suspend, or terminate any account we believe violates these Terms or poses a risk to the safety or integrity of the Platform or its users.

You are solely responsible for your own interactions and decisions. Diversifly Travel will not be liable for any loss, damage, injury, or harm arising from your reliance on information or representations made by other users.

9.3 Account Security
You are solely responsible for safeguarding your login credentials and all activity conducted through your account. Diversifly Travel is not liable for any unauthorised access, loss of data, or misuse resulting from:

Failure to maintain the confidentiality of your credentials;
Use of your account by anyone else, whether with or without your knowledge;
Hacking, phishing, or other forms of cyber attack.

9.4 Technology Disclaimer
The Platform is provided “as is” and “as available.” Diversifly Travel does not guarantee that the Platform will be secure, uninterrupted, or error-free. You access the Platform at your own risk and assume responsibility for any technical issues, data loss, or harm to your device.

9.5 No Guarantee of Social Connections
Diversifly Travel makes no guarantees regarding the number of users, the establishment of social or travel connections, or the success of any interaction. The Platform facilitates introductions but does not guarantee outcomes.

9.6 Third-Party Services
The Platform may include links to third-party websites or services. Diversifly Travel does not control or endorse any third-party content and is not responsible for the availability, accuracy, or safety of external sites.

10. Limitation of Liability

To the maximum extent permitted by law, Diversifly Travel will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or any content or services provided through the Platform.

11. Indemnification

You agree to indemnify and hold harmless Diversifly Travel, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Platform or your violation of these Terms of Use.

Diversifly Travel reserves the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, if we believe you have violated these Terms of Use or for any other reason.

We reserve the right to deny, restrict, suspend, or terminate access to the Platform or services at our sole discretion, at any time and for any reason, including but not limited to violation of these Terms or endangering user safety.

13. Assumption of Risk

You acknowledge and agree that travelling alone and meeting individuals through an online platform involves inherent risks. You assume full responsibility for your safety and wellbeing when using the Platform or interacting with users.

14. Force Majeure

Diversifly Travel is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, infrastructure failures, or internet outages.

15. Serverability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

16. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of its courts.
